Defined Terms
These terms use capitalized words with specific meanings. Here is what they mean:

- "Carrier Quote" means an insurance quote document or file uploaded to the Service by a User.

- "Proposal" means an AI-assisted comparison document generated by the Service based on one or more Carrier Quotes.
- "Customer Data" means all data, files, and content uploaded to or created in the Service by or for a User, including Carrier Quotes, agency information, Proposals, and client contact details.
Eligibility
The Service is available only to licensed insurance producers — individuals who hold a valid insurance producer license issued under applicable state law.
If you are in Washington State, this includes a license issued under RCW 48.17 (Producer, Solicitor, Adjuster Licensing).
By using the Service, you represent and warrant that:
- You hold a valid insurance producer license in your state of operation.
- You are using the Service in your professional capacity as a licensed insurance producer.
- You are not a general consumer, minor, or person prohibited from using the Service under applicable law.
The Service is not intended for general consumers or non-insurance business users.
The Service
ClearQuote helps independent insurance agents create AI-assisted proposal comparisons from carrier quotes. The Service includes:
- Quote upload — Upload carrier quote documents (PDF and other supported formats) for AI-assisted data extraction.
- AI extraction — The Service extracts and structures coverage details, premiums, and other information from uploaded Carrier Quotes.
- Proposal generation — The Service generates branded, AI-written comparison Proposals tailored to your agency's style settings.
- Email delivery — Deliver finished Proposals directly to your clients via branded email.
AI Content Disclaimer
Read this carefully. It affects your rights and responsibilities.
AI-generated content is for informational purposes only. You are solely responsible for reviewing all AI-generated content — including Proposals, summaries, comparisons, and recommendations — for accuracy, completeness, and appropriateness before sharing it with your clients.
ClearQuote is not liable for errors, omissions, or inaccuracies in AI-generated output. AI content may contain mistakes. Professional judgment is required before relying on it or presenting it to clients.
You acknowledge that:
- AI models can misread, misinterpret, or hallucinate information from Carrier Quotes.
- You are the licensed professional responsible for the advice and recommendations you provide to your clients.
- Sending an AI-generated Proposal to a client without reviewing it constitutes your independent professional judgment, not ClearQuote's.
Acceptable Use
You agree to use the Service only for lawful purposes and in ways consistent with these Terms. You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Access or attempt to access accounts, data, or systems you are not authorized to access.
- Use the Service for any illegal purpose or in violation of applicable law, including insurance regulations.
- Resell, sublicense, or provide third-party access to the Service without our written consent.
- Use automated scripts, bots, or scrapers to collect data from the Service beyond normal use.
- Upload malicious content, viruses, or any code designed to disrupt or damage the Service or other systems.
- Use the Service to transmit spam, harassing messages, or unsolicited commercial communications.
Your Data
You own your Customer Data. Uploading data to the Service does not transfer ownership to ClearQuote.
By using the Service, you grant ClearQuote a limited, non-exclusive, royalty-free license to process your Customer Data solely to:
- Provide the Service to you.
- Improve the Service's features and accuracy (in aggregate, de-identified form).
We do not sell, share, or use your Customer Data for advertising.
Important: Carrier Quotes and Proposals may contain NPI belonging to your insurance clients. In that relationship, you (the Agent) are the data controller and ClearQuote is the data processor. You are responsible for ensuring you have appropriate authorization to share client NPI with a service provider.

Payment Terms
The Service is offered as a monthly subscription.
- Price: $49 per month
- Free trial: 14-day free trial with up to 3 Proposals included. No payment method required to start.
- After trial: Subscription auto-renews monthly. You will be billed $49 per month until you cancel.
- Failed payments: If payment fails, we will send you past-due warning emails and allow a grace period before suspending account access.
- Price changes: ClearQuote may change pricing with at least 30 days advance email notice before the change takes effect.
- Payment processor: All payments are processed by Stripe.
ClearQuote does not store your payment card details. Stripe handles all payment processing and storage.
Account Termination
You may cancel at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service through the end of the period you have paid for. No mid-cycle refunds.
We may terminate or suspend your account if you violate these Terms, engage in fraud, or use the Service in a way that harms other users or ClearQuote.
After termination:
- Your Customer Data is retained for 30 days to allow you to export it.
- After 30 days, your Customer Data is permanently deleted from our systems.
- Stripe may retain billing records as required for financial and legal compliance.
Indemnification
You indemnify ClearQuote. You agree to defend, indemnify, and hold harmless ClearQuote and its officers, directors, and employees from claims, damages, and expenses (including reasonable attorney fees) arising from:
- Content you upload to the Service, including Carrier Quotes and client information.
- Your use of AI-generated content with your clients, including any errors in that content you chose to present.
- Your violation of these Terms or applicable law.
ClearQuote indemnifies you. ClearQuote agrees to defend, indemnify, and hold harmless you from third-party claims alleging that the Service itself (the platform and its core functionality) infringes their intellectual property rights — excluding AI-generated output, which is addressed above.
Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
To the fullest extent permitted by law, ClearQuote disclaims all warranties, including but not limited to:
- Merchantability — We make no warranty that the Service is fit for any particular purpose.
- Fitness for a particular purpose — We make no warranty that the Service meets your specific business needs.
- Non-infringement — We make no warranty that the Service does not infringe third-party rights.
- Uptime or availability — We do not guarantee uninterrupted access or any specific level of availability.
Liability cap. ClearQuote's total aggregate liability to you for any claims arising out of or related to the Service is limited to the total fees you paid to ClearQuote in the 12 months immediately preceding the event giving rise to the claim (maximum $588 at current pricing of $49/month).
Excluded damages. IN NO EVENT SHALL CLEARQUOTE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — including but not limited to lost profits, lost revenue, loss of data, or business interruption — EVEN IF CLEARQUOTE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This limitation applies regardless of the theory of liability (contract, tort, negligence, or otherwise).
Dispute Resolution
These Terms are governed by and construed under the laws of the State of Washington, without regard to conflict-of-law principles.
Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in King County, Washington. You consent to personal jurisdiction in those courts.
Class Action Waiver
You agree that any dispute or claim arising out of or related to these Terms or the Service will be resolved on an individual basis. You waive any right to participate in a class action lawsuit, class arbitration, consolidated proceeding, or representative proceeding of any kind against ClearQuote.
Insurance-Specific Compliance Framing
ClearQuote is a technology service provider, not an insurance regulator or compliance officer.
GLBA framing. ClearQuote, as a service provider, supports Customer's compliance with applicable regulations, including the Gramm-Leach-Bliley Act (GLBA) Safeguards Rule. ClearQuote's security practices — including encryption at rest and in transit, Row-Level Security on all data tables, rate limiting, and ongoing security testing — are designed to support your compliance obligations as a GLBA-regulated entity.
Washington State insurance producers. Customers operating as Washington State licensed producers may have additional obligations under RCW 48.135 (Insurance Data Security) and related statutes. ClearQuote's security practices are designed to support, but do not replace, Customer's own regulatory compliance program.
You are responsible for your own compliance with applicable insurance regulations, including GLBA, NAIC guidelines, and state-specific requirements in your state of licensure.
Changes to These Terms
ClearQuote may update these Terms from time to time. For material changes, we will:
- Send you an email notification at least 30 days before the new Terms take effect.
- Display the updated "Last updated" date at the top of this document.
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the new Terms.
If you do not agree to the updated Terms, you may cancel your account before the effective date.
