ClearQuote is not liable for errors, omissions, or inaccuracies in AI-generated output. AI content may contain mistakes. Professional judgment is required before relying on it or presenting it to clients.

Acceptable Use

You agree to use the Service only for lawful purposes and in ways consistent with these Terms. You agree not to:


Your Data

You own your Customer Data. Uploading data to the Service does not transfer ownership to ClearQuote.

By using the Service, you grant ClearQuote a limited, non-exclusive, royalty-free license to process your Customer Data solely to:

Payment Terms

The Service is offered as a monthly subscription.

ClearQuote does not store your payment card details. Stripe handles all payment processing and storage.


Account Termination

You may cancel at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service through the end of the period you have paid for. No mid-cycle refunds.

We may terminate or suspend your account if you violate these Terms, engage in fraud, or use the Service in a way that harms other users or ClearQuote.

Indemnification

You indemnify ClearQuote. You agree to defend, indemnify, and hold harmless ClearQuote and its officers, directors, and employees from claims, damages, and expenses (including reasonable attorney fees) arising from:

ClearQuote indemnifies you. ClearQuote agrees to defend, indemnify, and hold harmless you from third-party claims alleging that the Service itself (the platform and its core functionality) infringes their intellectual property rights — excluding AI-generated output, which is addressed above.


Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by law, ClearQuote disclaims all warranties, including but not limited to:

Liability cap. ClearQuote's total aggregate liability to you for any claims arising out of or related to the Service is limited to the total fees you paid to ClearQuote in the 12 months immediately preceding the event giving rise to the claim (maximum $588 at current pricing of $49/month).

Excluded damages. IN NO EVENT SHALL CLEARQUOTE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — including but not limited to lost profits, lost revenue, loss of data, or business interruption — EVEN IF CLEARQUOTE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This limitation applies regardless of the theory of liability (contract, tort, negligence, or otherwise).


Dispute Resolution

These Terms are governed by and construed under the laws of the State of Washington, without regard to conflict-of-law principles.

Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in King County, Washington. You consent to personal jurisdiction in those courts.


Class Action Waiver

You agree that any dispute or claim arising out of or related to these Terms or the Service will be resolved on an individual basis. You waive any right to participate in a class action lawsuit, class arbitration, consolidated proceeding, or representative proceeding of any kind against ClearQuote.


Insurance-Specific Compliance Framing

ClearQuote is a technology service provider, not an insurance regulator or compliance officer.

GLBA framing. ClearQuote, as a service provider, supports Customer's compliance with applicable regulations, including the Gramm-Leach-Bliley Act (GLBA) Safeguards Rule. ClearQuote's security practices — including encryption at rest and in transit, Row-Level Security on all data tables, rate limiting, and ongoing security testing — are designed to support your compliance obligations as a GLBA-regulated entity.

Washington State insurance producers. Customers operating as Washington State licensed producers may have additional obligations under RCW 48.135 (Insurance Data Security) and related statutes. ClearQuote's security practices are designed to support, but do not replace, Customer's own regulatory compliance program.

You are responsible for your own compliance with applicable insurance regulations, including GLBA, NAIC guidelines, and state-specific requirements in your state of licensure.


Changes to These Terms

ClearQuote may update these Terms from time to time. For material changes, we will:
